General Conditions of Use

 Welcome to the “Explore Grand Est” platform, a service created and developed by the Grand Est Regional Tourism Agency, a Local Law Association (Bas-Rhin, Haut-Rhin and Moselle), with its head office at Château Kiener 24 rue de Verdun, 68000 Colmar and registered under SIREN number 848 825 196 (hereinafter referred to as “Grand Est RTA”).

These General Conditions of Use (hereinafter referred to as “GCU”) are intended to govern your use of the Platform available on the www.explore-grandest.com website, a platform for presentation of tourism offers (hereinafter referred to as “Explore Grand Est Platform” or “ the Platform”).

All use of the Platform and its services implies unconditional acceptance of these GCU. These CGU apply without prejudice to the relevant legal provisions, in particular those provided for in the Consumer Code. Anybody browsing and/or creating an account on the Platform is referred to as a “User”.

You can also consult our Privacy Policy for more information on how the Grand Est RTA collects and uses data relating to the Platform’s use and results, as well as our responsibilities and your rights with regard to processing your personal data.

Preamble:

1. Acceptance of these GCU

By entering the Platform and ticking the box “I certify that I have read and unconditionally accepted the Platform’s GCU”, you declare and guarantee that you have read and accepted these GCU and undertake to comply with them.

Use of the Platform is restricted to natural persons aged 18 and above with full legal capacity. Minors are strictly prohibited from registering on the Platform. By accessing, using or registering on the Platform, you declare and guarantee that you are 18 years of age or above and are legally competent.

The Platform reserves the right to amend or replace these GCU at any time. The date of the most recent amendment appears at the end of these GCU.

2. Presentation and description of the Platform 

Pursuant to Article 6 of Act no.2004-575 of 21 June 2004 on confidence in the digital economy, Users of the Platform are provided with the identity of the various entities involved in its creation and monitoring:

The Platform is a referencing service for the Grand Est’s marketable tourist service offers reservable online (“Offers”). The Platform’s purpose is to put travellers in contact with tourism professionals in the Grand Est Region and crossborder regions (Luxembourg, Germany and Liechtenstein). Users who publish and offer tourism services for sale are service providers (“Providers”).

Providers’ offers may be sold directly by them or via a partner vendor (“Vendor”).

At any time, Grand Est RTA may add new services, resources and functionalities to the Platform, and publish new versions. Such new services and functionalities will be governed by these GCU as well as any complementary conditions that the Platform may publish with regard to specific services or functionalities. 

Article 1. Creating your account

Creating an account also enables you to access such functionalities as:

  • Adding Offers to your Favourites basket,
  • Registering your preferences

During creation of their Account, the User must provide their family name, first name, email address, town of residence, year of birth and a valid password via the account creation form.

The User must make sure that the email address they provide is valid. This address and all other personal information they choose to communicate to the Platform will be processed in compliance with the Platform’s Privacy Policy.

It is the User’s responsibility to keep their password confidential and in security. They will be held responsible for all use made of their password or Account as well as any activity emanating from their account, whether such activity was or was not authorised by them. The User must inform Grand Est RTA immediately of any unauthorised use of their Account, username or password.

Providers can modify the password communicated from their Accounts, on the Platform in the "Manage your profile" section.

Grand Est RTA reserves the right to remove a User’s name at its discretion and may suspend or terminate an Account, with or without notice, if the Account shows evidence of activities that, at its sole discretion, appear to constitute or could constitute a breach of these GCU, or a violation of the rights of third parties or of any legislation or regulation currently in force.  The User also undertakes not to publish infringing content and, in particular, not to disseminate content prejudicial to third-party rights.

The User may delete their account at any time, by making their request to the following email address: utilisateurs@explore-grandest.com 

Article 2. Looking for Services on the Platform

The User can look for tourism services on offer from Providers and/or Vendors by using such search criteria as type of service desired, destination, dates of service, and number of participants. The User can use various filters in order to refine their search results. Search results are largely based on their relevance with regard to the search carried out by the User.

When the User wishes to reserve a Service, they click on the Service’s descriptive offer and, if necessary, enter the dates for which they wish to reserve the Service. If the Service is available for the preselected dates, the User checks and, if required, corrects the content of their pending reservation before confirming it by clicking on the [“Reserve”] button.

The Grand Est RTA Platform is a solution for putting travellers in contact with tourism professionals. Grand Est RTA can in no case act as the vendor of a Service. The Vendor’s identity is stated on each Offer.

Article 3. Reservation

Before finalising their reservation, the User must consult and download the General Conditions of Sale published by the Vender they are about to enter into a contract with. In particular, they should consult the Service’s conditions for cancellation, reimbursement and modification of reservation.

By ticking the box “I certify that I have read and unconditionally accepted the GCS” (or equivalent wording used by the Vendor), they declare that they have read and accepted such GCS and undertake to comply with them. They may then make the payment due to the Vendor for provision of the service.

Article 4. Limitation of liability

Grand Est RTA may in no case be the vendor of the tourism services on offer. It may in no case be held liable in the event of damage arising from the performance or non-performance of Services highlighted on the Platform.

Nor may Grand Est RTA be held liable for direct or indirect damage caused to the User’s equipment during access to the Platform, and resulting either from use of equipment not meeting the specifications required for use of the Platform or from the appearance of a bug or technical incompatibility.

The User acknowledges that they have checked that the computer configuration they use is secure and in operational state.

Nor may Grand Est RTA be held responsible for indirect damage (such as loss of market or loss of opportunity) resulting from use of the Platform.

The Platform contains a number of hypertext links to other websites. However, Grand Est RTA cannot check the contents of sites visited via such links, and in consequence shall have no liability in their regard.

Article 5. Alert procedure and reporting of abuse

In the context of the alert procedure described below, all Users are asked to inform Grand Est RTA of any fraudulent use of the Platform and its Services that they have knowledge of, and in particular, any content that contravenes the prohibitions set out in these GCU and, more generally, any legal and regulatory provisions currently in force.

Similarly, if it appears that certain Offers on the Platform violate your intellectual property rights (copyright, trademark rights, image rights, etc.) or any other right, please report the fact by email to the following address: utilisateurs@explore-grandest.com including the following information:

  • Notifier’s identity,
  • Description of the facts at issue and their exact location,
  • Reasons for which the content should be removed, including reference to the relevant legal provisions.

Article 6. Intellectual Property

d all its other components (graphic charter, domain name, logo, etc.) are the sole property of Grand Est RTA.

Any reproduction or representation, whether wholly or in part, of the Platform and/or its components by whatever procedure, without Grand Est RTA’s express authorisation, are therefore prohibited and constitute an infringement punishable under Articles L. 335-2 ff. of the Intellectual Property Code.

Article 7. Termination

These GCU may be terminated at any time by deleting your Account and/or ceasing to use the Platform (for Users). In order to delete your Account, you will have to send a deletion request by email to the following address: utilisateurs@explore-grandest.com. Once your Account has been deleted, all content loaded and stored on it or relating to an activity on your Account will be irrecoverably deleted by the Platform.

Article 8. Nullity of a Clause

In the event of one of the provisions of these GCU being declared invalid or unenforceable for whatever reason, the other clauses shall remain applicable without change, except in cases where the contract cannot continue to exist without it.

Article 9. Protection of personal data

Data collected
In the context of its activity, the Platform implements and exploits processing of Users’ personal data. In this regard, the Platform collects the following personal data:

  • Family status, family name, first name, birthdate, email address, postal address, telephone number and password,
  • Preferred types of services and accommodation.

Aims Pursued
The Platform collects and processes all or part of your data so as to:

  • Enable you to browse on the Platform and adapt its contents to your terminal in order to improve your browsing;
  • Memorise the information you have provided when you registered and/or took out a subscription;
  • Enable you to share the Platform’s contents on social networks;
  • Send external information and/or communications;
  • Analyse the Platform’s audience and  numbers of visits;
  • Carry out email marketing;
  • Improve/develop UX (user experience) through use of analysis software (e.g. Google Analytics, Hotjar and AB testing software).

Individuals authorised to access data
The following individuals are authorised to access Personal Data collected by Grand Est RTA: Grand Est RTA and its partners’ employees involved in the  Services requested by Users and, where applicable, Grand Est RTA’s subcontractors participating in provision of such Services and therefore involved in processing operations, it being understood that, in such cases, whether involving partners or subcontractors, access is in full compliance with the regulations currently in force.
 
Data retention
Personal data collected are retained for the legal retention period relating to the purpose of their processing and at most for 3 years as from the last exchange that you had with the Platform at your own initiative.

Grand Est RTA implements organisational, technical, software and physical digital security measures in order to protect Personal Data against deterioration, destruction and unauthorised access. However, it should be borne in mind that the Internet is not a completely secure environment, and Grand Est RTA cannot guarantee the security of transmission or storage of information on Internet.

Data subjects’ rights
You have the right to query, access, modify and erase your Personal Data and the right to obtain a copy of the  Personal Data that we hold in a structured electronic format (portability).

You also have a right of objection, on legitimate grounds, to the processing of your Personal Data, and a right of objection to your   Personal Data being used for marketing purposes.

We undertake to  respond to such requests within  1 month. Such period may be extended by a further month depending on the complexity and number of requests received. In the event of there being reasonable doubt regarding your identity, we may ask you to provide any supplementary information required to confirm your identity.

Amendments to Clauses
This Privacy Policy may be amended or adjusted at any time. If an amendment is made to this Policy, Grand Est RTA undertakes to publish the new version on the Platform.

For further practical information on the exercise of your rights, we recommend that you consult the National Commission for Information Technology and Civil Liberties (CNIL) website, especially page https://www.cnil.fr/fr/comprendre-vos-droits.

Article 10. Dispute resolution

These GCU are governed by French law.

Any complaint relating to these GCU’s Platform may be addressed to our Customer Service Department at the following address:  utilisateurs@explore-grandest.com so that it can be processed as rapidly as possible.

In the event of failure to reach an amicable solution, any disputes regarding the validity, interpretation and/or execution of these GCU shall be brought before the competent courts, even in the event of their being more than one defendant or of introduction of third parties.
